These Terms of Service (“Terms”) govern your access to and use of ReachFalcon, a product operated by Samero LLC.
By creating an account, purchasing a subscription, or using ReachFalcon, you agree to these Terms.
If you use ReachFalcon on behalf of a business or organization, you represent that you have authority to accept these Terms on its behalf.
1. ReachFalcon
ReachFalcon provides tools that may include:
- Prospect management
- CSV import
- Personalized images
- Personalized videos
- Website or webpage capture
- Dynamic personalization
- Email campaigns
- Mailbox connections
- Campaign scheduling
- Follow-ups
- Reply and bounce processing
- Campaign analytics
- Related outreach functionality
Features may change, be introduced gradually, or vary by plan.
2. Account Eligibility
You must be at least 18 years old or the applicable age of legal majority to use ReachFalcon.
You must provide accurate account information and keep your login credentials secure.
You are responsible for activity performed through your account unless caused directly by a security failure attributable to ReachFalcon.
3. Your Responsibility for Outreach
ReachFalcon provides outreach software. We do not determine who you should contact or whether you have a legal right to contact them.
You are responsible for:
- The contacts you upload
- The sources of your prospect data
- Your legal basis for processing personal information
- Your email content
- Your sender identities
- Your domains and mailboxes
- Your unsubscribe process
- Your suppression lists
- Your campaign settings
- Your compliance with applicable laws
- Your compliance with applicable third-party platform rules
Different countries apply different rules to commercial email. For example, U.S. CAN-SPAM applies to commercial email, including business-to-business commercial email, while UK rules distinguish between different subscriber types and circumstances.
You must determine which rules apply to your campaign before sending it.
4. Required Email Practices
Where required by applicable law, you must:
- Accurately identify the sender
- Avoid misleading sender information
- Avoid deceptive subject lines
- Provide required business identification
- Provide a valid way to opt out
- Honor unsubscribe requests
- Include a valid physical postal address where required
- Obtain consent where required
- Maintain any legally required suppression records
ReachFalcon may provide features that make some of these actions easier, but you remain responsible for compliance.
5. Prohibited Use
You may not use ReachFalcon to:
- Send unlawful spam
- Conduct phishing campaigns
- Distribute malware
- Commit fraud
- Impersonate another person or organization
- Send deceptive or fraudulent messages
- Harvest credentials
- Harass or threaten people
- Circumvent unsubscribe requests
- Contact individuals after you are legally required to stop
- Distribute illegal content
- Violate intellectual property rights
- Access systems without authorization
- Attempt to compromise ReachFalcon's infrastructure
- Resell unauthorized access to ReachFalcon
- Use stolen payment information
- Intentionally damage sender infrastructure or third-party systems
- Use the platform in violation of applicable sanctions or export laws
We may suspend or terminate accounts involved in abusive activity.
6. Prospect Lists
You may upload prospect information to ReachFalcon only when you have the right to possess and process that information.
Uploading data to ReachFalcon does not transfer ownership of that data to ReachFalcon.
You remain responsible for your lists and their source.
ReachFalcon may restrict or suspend campaigns where we reasonably believe a list is being used for fraud, unlawful spam, abuse, or activity that could materially harm our infrastructure or other users.
7. Website and Social Profile Content
ReachFalcon may allow you to supply website URLs, public webpage URLs, social profile URLs, images, or other sources for personalization.
You are responsible for ensuring that:
- You have the right to use the supplied material
- Your use complies with applicable law
- Your use does not infringe third-party rights
- Your use complies with applicable third-party terms
ReachFalcon does not grant you ownership of third-party content simply because our service can process, display, capture, or personalize it.
8. Customer Content
You retain your rights to content you upload or create through ReachFalcon.
You grant ReachFalcon a limited right to host, process, transmit, reproduce, modify, and display your content only as reasonably necessary to:
- Provide the service
- Generate requested assets
- Send campaigns
- Store your projects
- Troubleshoot problems
- Secure the platform
- Provide support
This permission ends when the relevant content is deleted, subject to reasonable backup, legal, and technical retention requirements.
9. ReachFalcon Intellectual Property
ReachFalcon, its software, branding, interface, systems, templates provided by ReachFalcon, documentation, and related intellectual property belong to Samero LLC or applicable licensors.
Your subscription gives you a limited, non-exclusive, non-transferable right to use ReachFalcon while your account remains authorized.
It does not transfer ownership of ReachFalcon technology to you.
10. Subscriptions and Billing
Certain ReachFalcon features require payment.
Pricing, included usage, credits, limits, and plan features are shown on the applicable pricing or checkout page.
By purchasing a recurring subscription, you authorize recurring charges according to the billing cycle shown during checkout until you cancel.
Taxes may be added where required.
11. Usage and Limits
ReachFalcon plans may include limits for items such as:
- Prospects
- Personalized images
- Video minutes
- Email sends
- Mailboxes
- Storage
- Workspaces
- Other features
Usage is measured according to ReachFalcon's billing system.
You may be required to upgrade, purchase additional usage, or wait until your next billing cycle after reaching a limit.
12. Cancellation
You may cancel a recurring subscription before the next renewal.
Unless otherwise stated during cancellation, your paid access remains available until the end of your current billing period.
Cancellation prevents future renewal charges but does not automatically create a refund for the current billing period.

13. Changes to Pricing
We may change subscription prices or plan structures.
Changes generally apply to future billing periods.
Where reasonably required, we will provide notice before materially changing the price of an existing recurring subscription.
14. Suspension and Termination
We may suspend, restrict, or terminate access if:
- You materially violate these Terms
- Payment remains overdue
- We detect fraud
- Your activity creates a security risk
- Your campaigns create serious abuse or deliverability risk
- Your usage may violate applicable law
- Your actions threaten ReachFalcon or other users
Where reasonable, we may provide an opportunity to correct the issue.
Immediate action may be taken for serious abuse, fraud, security incidents, or unlawful activity.
15. Deliverability
ReachFalcon cannot guarantee:
- Inbox placement
- Open rates
- Reply rates
- Conversion rates
- Sender reputation
- Domain reputation
- Email-provider acceptance
Deliverability depends on factors outside ReachFalcon's control, including your domain, mailbox, message content, sending behavior, recipient engagement, provider policies, spam filters, and reputation.
16. Third-Party Services
ReachFalcon relies on third-party infrastructure and may integrate with services such as email providers, payment providers, hosting providers, social platforms, and other APIs.
Third-party services may change, restrict, suspend, or discontinue functionality.
ReachFalcon is not responsible for a third party's independent services, policies, downtime, account restrictions, or decisions.
17. Service Availability
We work to keep ReachFalcon reliable but do not guarantee uninterrupted or error-free availability.
The service may occasionally be unavailable because of:
- Maintenance
- Updates
- Infrastructure problems
- Third-party outages
- Security incidents
- Events beyond our reasonable control
18. Beta and New Features
Some functionality may be marked beta, experimental, early access, preview, or similar.
These features may change significantly, contain errors, or be discontinued.
19. No Professional Advice
ReachFalcon provides software tools.
We do not provide legal advice, tax advice, data-protection advice, email-deliverability guarantees, or professional marketing advice.
You are responsible for determining whether your use complies with applicable requirements.
20. Disclaimer of Warranties
To the maximum extent permitted by law, ReachFalcon is provided on an “as available” basis.
We do not guarantee that ReachFalcon will:
- Always be available
- Be completely error-free
- Produce specific campaign results
- Prevent all data loss
- Work with every website or provider
- Avoid every spam filter
- Generate perfect personalized content
Nothing in these Terms excludes warranties or rights that cannot legally be excluded.
21. Limitation of Liability
To the maximum extent permitted by applicable law, Samero LLC and ReachFalcon will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages arising from your use of ReachFalcon.
This includes, where legally permitted, losses related to:
- Lost profits
- Lost opportunities
- Lost data
- Email deliverability
- Domain reputation
- Account restrictions
- Campaign performance
- Third-party services
To the maximum extent permitted by law, our aggregate liability relating to the service will not exceed the amount you paid to ReachFalcon during the 12 months immediately preceding the event giving rise to the claim.
This limitation does not apply where applicable law does not allow such a limitation.
22. Indemnification
To the extent permitted by law, you agree to indemnify and hold Samero LLC harmless from third-party claims resulting from:
- Your unlawful campaigns
- Your customer content
- Your prospect lists
- Your violation of these Terms
- Your violation of third-party rights
- Your misuse of ReachFalcon
23. Changes to These Terms
We may update these Terms as ReachFalcon evolves.
Material changes may be communicated through the service, by email, or by posting updated Terms.
Continued use after the effective date of updated Terms constitutes acceptance where permitted by law.
24. Disputes
Before starting formal proceedings, you agree to contact us and make a reasonable attempt to resolve the dispute informally.

These Terms are governed by the laws applicable to Samero LLC in the United States, subject to any mandatory consumer protections that apply to you.
